前年度は1231年編纂の法典『シチリア王国勅法集成』における、地方「司法官」制度を検討した。その結果、以下のことが明らかになった。すなわち、従来シチリア王国地方「司法官」制度は、国王フェデリーコ2世の主導により、当初から体系的かつ完成された制度として成立したと見なされてきたが、実際には、この制度が現実に施行されるなかで幾多の困難に直面し、多くの追加立法がなされたこと。換言すれば、この地方「司法官」制度は漸進的に形成されてきたこと、である。それを踏まえ、さらなる研究課題として、地方「司法官」制度形成における、12世紀ノルマン朝期の制度の把握の重要性を認識した。平成10年度は、こうした検討を踏まえて、検討の枠を12世紀末まで拡大し、ノルマン時代末からスワビア時代初期、すなわち1189年から1220年までの王国行政制度、とりわけ地方「司法官」制度の発展を検討した。従来定説では、この時代は王国の混乱期=「危機の時代」であると認識され、地方「司法官」制度を含め、地方行政制度は政治混乱の中で解体した、とされてきた。しかしながら、近年こうした定説的見解を疑問視する研究が、相次いで発表された。このうち以下二つの研究を検討した。すなわち、1)イタリアのカラヴァーレの研究によれば、この時代の諸史料には「司法官」への言及をはじめ、地方行政活動の継続を示す幾多の証拠がみられること。つまり、この混乱の時代にも王国の行政活動は連続していたこと。また2)フランスのマルタンの研究によれば、この時代に各地域の在地貴族層(とりわけ伯)が、地方「司法官」制度を含め、ノルマン時代の制度に依拠しつつ自らの勢力拡大を図っていたこと。それゆえ、ノルマン時代の制度の枠組みは形式的には維持されていた、という。これらの新研究によって、今後さらに地方「司法官」制度を制度発展の文脈の中で検討することが可能となったと思われる。
