项目摘要

2001年度の研究では、本研究課題における2つの新規性(1・刑事法学においてフィールドワークの手法を確立するという点。2・離島刑事弁護の貧困の改善に関し司法制度改革において十分議論されていない点に留意しつつ、日本各地で調査を行うという点)に加え、3・離島の司法福祉の貧困を法曹に啓発する方策の研究、4・特に離島を中心とする人権啓発教育活動の貧困に気付き、個別具体的事案の解決の方策に加え、刑事弁護や被害者救済、法律専門機関へのアクセスに関する、様々な法律専門職による法的啓発活動を試行するための手法の確立にも努力した。2001年度には、「司法制度改革審議会」による最終答申をうけた「司法制度改革推進本部」が発足した。推進本部には、この研究に関係する問題を議論する場として、司法アクセス、裁判員・刑事、公的弁護の3検討会が設けられているが、この研究において指摘しつづけてきた「離島の司法過疎・刑事弁護の貧困さ」は、残念ながら殆ど議論されないまま、今日まで推移している。しかし、現段階では、研究を議論し、実践する場として、小笠原諸島と三宅島にサポート専門家グループが発足した。特に、日本で一番司法過疎の貧困にあえぐ小笠原諸島に関しては、学者、弁護士、司法書士、税理士、公証人などが集まり、2002年度中には、専門家グループをNGOとして組織化する計画が具体化した。また、小笠原村当局も啓発、相談活動に対して公的補助を福祉関係予算から支出することにし、議会で承認された。また、当職の研究が、弁護士会の地域司法計画策定に関し、反映され、岐阜県弁護士会主催の地域司法計画実現市民集会では、研究報告をし、具体的には、ローカル・エリアの法啓発のための「岐阜裁判所利用ガイド・うちんたぁの法律家」を2002年4月末に刊行することとなった。
