正義・公平を内実とした普遍的原則に従い、自律した個人間の関係を調整する近代の正統的な倫理観に対して、ケアの倫理観は人間の傷つきやすさと状況・個人の個別性に立脚する。本研究は、(1)ケアの倫理の倫理学的含意、有効な射程の範囲、その拠って立つ根拠を、(2)相対立する倫理観と競合させながら問うことを目的とした。平成15年度は、(1)については、N・ノディングスのケアの倫理に焦点をあてた。ノディングスはケアの倫理の創始者ギリガン以上に正義の倫理と対立しており、それゆえ、その思想には正義に依拠しないケアの倫理の基礎づけと限界がみてとれるからである。通常、母性愛という自然な傾向がその基礎と理解されている。私見は自然なケアリングと倫理的ケアリングとの区別に着目し、ノディングスの倫理全体を「ケアする者としての自己=倫理的自己」への誠実に基礎づけた。これによって、他者に配慮するケアの倫理が自己志向に基づいている点について整合的な解釈を示すことができ、同時に、他者を倫理的自己と同格に捉えないゆえのその限界を露呈できた。(2)については、(1)医療・看護におけるケア論に音及したR・ヴィーチの『生命倫理学の基礎』を監訳、(2)J・レイチェルズの訳書を書評し、レイチェルズがケアの倫理を徳倫理に包摂して私的領域の規範として過小評価している点を批判した。(3)他方,ケアの倫理が主張する弱者への保護を正義の倫理の文脈のなかに摂取している試みも確認できた。弱者としての胎児に対する尊重の論拠を説くハーバマスの出生前診断論とドゥオーキンの中絶論を扱った論文「生命の神聖-その失効とその再考」(『応用倫理学講義 生命』所収)はその成果のひとつである。また、前年度報告書に記した修復的正義については論文化に至らぬものの読解を進めている。今後は、ケアの倫理と正義の倫理との対立・補完関係とともに、ケアの倫理と共通点をもつ責任の原理など他の思想心も含めた広い文脈のなかに問題を位置づけて研究を継続する予定である。
