ドイツ刑法判例・学説の「治療行為制約論」は、生命維持治療の制約要因として、親が同意権を濫用して呈示した治療拒絶意思をも刑法上有効と解し、治療拒絶それ自体を規整するための有効な法原理を定立しえていない。また、ドイツ刑法学説の「治療義務限定論」は、親による治療拒絶の問題については、その事後的結果たる治療放棄に着目し作為義務論の枠内で微視的に把捉するにすぎない。そのため、本来は、生命維持治療の不作為の適法性について論ずる以前に、「治療行為制約論」のもとで生命維持治療のための作為に対して親の拒絶意思が不当に事前抑制的に作用する点をまず問題視すべきであるにも拘わらず、「治療義務限定論」は、この点に対し批判的な検討を加える理論的契機を失い、やはり治療拒絶に対する有効な法的規整原理を示しえていない。このような刑法上の理論状況とは対蹠的に、民法・福祉法領域では、同意権の濫用への司法的介入が積極的になされ、親の治療拒絶意思を排除し治療放棄を事前に回避するための措置が可能となっている。これにより「治療行為制約論」の暇疵が超克され、年少患者の権利擁護の点からみて、治療拒絶への法的規整が実質化している。しかし、「治療行為制約論」が生命維持治療を不当に制約することがそもそも問題であり、刑法理論としても、親が同意権を濫用して呈示した治療拒絶意思は、司法的介入を待つまでもなく無効であり、当該拒絶意思に反した治療行為を違法とし処罰するべきではない。この点に関しては、推定的同意の法的性格をめぐる議論-専ら同意論のもとに本人の自己決定の延長上においてその主観的な意思方向に着目するのか、あるいは違法阻却の一般原理である優越的利益の原理に則して行為の客観的な優越利益性を考慮に入れるのか-なども踏まえつつ、さらに理論的深化を図ることが今後の課題となる。
