弁護士過疎地の事例として青森、地方の中心都市の事例として札幌を選び、それぞれにおいてランダムの面接調査と全数の質問票調査を行った。なお、東京における調査のうち、弁護士会における当番弁護士関係の資料収集は終了したが、面接調査はまだ終了していない。(1)国選弁護の受任状況は、青森と札幌では東京と大きく異なり、高令者と一部の極めて少数の弁護士を除き、ほぼ全員が国選事件を受任している。しかし、青森に比べて札幌では弁護士によって受任件数が大きく異なっており、国選受任を避けようとする傾向が部分的に表れてきている。(2)青森および札幌でも、国選事件と私選事件とで扱いの異なる傾向は一部で見られるようである。しかし、東京ほど極端な話しは聞かなかった。(3)青森のみならず札幌でも(札幌の弁護士によれば、企業関係の仕事は「支店経済」のため規模が小さい)、弁護士報酬の単価も、民事事件を受任する最低額も、東京より低いようである。事務所維持経費も安い。このため、刑事事件の受任は、積極的に増やしたいという弁護士は少ないが、わずらわしいとは感じられていないようである。これには、ほぼ全員が国選事件を年に数件は受任していることも影響しているであろう。特に、青森では、刑事事件からの報酬が事務所経営にいくらかの貢献をしていると見られている(一部に例外あり)。これに対して、札幌では、刑事を私選でもほとんど受けない弁護士が出てきており、少数ではあるが、企業関係の法律業務への業務拡大を積極的に志向する弁護士もいる。(4)東京と異なり、弁護士会の影響力ははるかに強いように思われた。おそらくはこのためと、刑事弁護を普段から行っているために、当番弁護士としての活動は高い割合の弁護士の間で行われている。(5)当番弁護士制度は、弁護士によれば、刑事弁護によい影響を与えている。ただし、これを実証するデータが無いため、今少し状況を見守る必要があろう。
