现代社会中的赔偿问题在国家责任、工伤事故赔偿、消费者保护、责任等诸多领域日益突出，在这些领域中，国家在应该赔偿的时候，总是需要决定是否应该赔偿，或者赔偿多少才是合理的。目前，在某些领域国家赔偿责任不断增加的同时，也存在着某些领域缺乏必要的赔偿责任的问题。如何正确认识国家赔偿责任的多领域性和跨领域性，是一个重要而紧迫的课题。本课题试图从跨学科的角度来研究这些问题，重新审视国家与赔偿的关系。特别是国家、地方公共机构和民间团体在赔偿中的地位，赔偿的自由原则，赔偿责任的原因，赔偿数额的确定，以及与社会保障、保险和民事责任的比较等问题。

The problem of compensation in the modern society id growing more and more serious in manv fields such as state liability, workers' accident compensation, consumer protection, responsibility etc. A state is always requesed to decide whether it should make compensation in such many fields, or how much amount of compensation is reasonable, when it should. Until now while its compensation liability is increasing in some fields, there are some fields where necessary compensation is lacking, It is an important and urgent task to resolve problems how we should unserstand compenstion in each of many fields and compensation in general beyond each fieldThis project tries to research these problems in a manner of interdiscipline ar reexamone a relation between states and compensation. The research attaches especially importance to (1) the role which a state, local public entities and the civilian party respectively, (2) principle bfremedy in compensation, (3) cause of liability, ]5) decision of an amount, in comparison with social security,insurance and civil liability etc.
