本研究は19世紀初めからのイギリス植民地支配下において、インド社会の骨格をなすカースト制度がどのような変容を示したのかという問題を、とくに司法制度、法制度の変化という点から考察しようとした。具体的には、イギリス植民地支配下、インド各地におかれたさまざまな裁判所の判例集をできるかぎり収集し、カースト制にかかわる訴訟の判例を抽出するという作業を行なった。自分自身のフィールドとの関係で、とくにボンベ州(管区)の裁判所について集中的に作業した結果、かなり大量の判例を集めることができた。その次に、カーストにかかわるいろいろな法律の立法過程を明らかにするために、各州(管区)政府の立法参事会の議事録をマイクロフィッシュで収集した。これを、立としてボンベイ管区の議事録(1862〜1939年)の分析を行ない、重要な法律の立法過程にどのような意見の対立があったかということをほぼ明らかにしえた。このような作業の結果の一端は拙稿「カーストの保治政策とカースト集団」(南アジア学会編『南アジア研究』第4号、1992年10月)に示されている。本年度行なった作業は基礎的な史料整理という面が強いのであるが、これらの作業にもとづいて、今後数本の論文を用意するつもりでおり、すでに未刊ではあるが、1本完成している。(「不可能民マハールの歴史」、1994年4月刊行予定の案著『カースト制と被差別民』第二巻、明石書店に収載)

This study examines the changes in the judicial system and legal system under the control of the people in the early 19th century. The specific case law of the court is under the control of the people, and the case law of the court is extracted from the case law. Secondly, as the legislative process of the law becomes clear, the minutes of the legislative councils of state (district) governments will be collected in a comprehensive manner. One of the results of this work was presented in the manuscript "Protection Policy and Policy Group"(Nankai Research Institute, No. 4, October 1992). This year's work is based on the compilation of historical materials, and the purpose of several papers in the future is not published.
