補助を受けた92年度は、私達の3年間の共同研究の一年目にあたり、「法と経済学」の基本的な考え方、その影響、それに対する批判を概観することを主要な目的とした。共同研究会では、ダンカン・ケネディの「コスト・ベネフィット分析批判」、ポズナーの「懐疑論の法学」、マクロスキー「経済学のレトリック」、「所得分配と公平性の問題」(倉本報告)、「コースの定理の分析」(野方報告)、「ドイツにおける中小企業の営業規制」(近藤報告)をとりあげて検討した。検討の結果は、それぞれ雑誌論文として公表された。ケネディのコスト・ベネフィット分析批判は、法と経済学に対する内在的批判を試みたものであるが、検討の結果、その論証は必ずしも十分でないとの結論に至った。ポズナーの論文は、コモンローの効率性を強調してきた著者が、ホームズ以来の懐疑論に共感を表明したものである。法と経済学との関連が注目されるが、私達においてまだ十分に整理できていない。(93年に公表予定)野方のコースの定理分析は、限界利潤と限界損失という概念を用いて、別の角度からの分析を試みたものである。近藤報告は、ドイツにおけるマイスター制度の検討から、中小企業に対する国家の規制の複雑な内容を整理しようとするものである。私達は、93年度も研究を継続し、神戸外大の「外国学研究」に、その成果を公表する予定であります。
