伝統中国において成立した「法治」と「徳治」の観念は、帝政期に礼法一体の観念として完成され、その影響は、社会主義中国においても大きな影響を残していると考えられる。今回の研究では、漢代に董仲舒によって完成された礼法一体論の内容およびその歴史的・社会的背景を明らかにすると同時に、法の倫理化、法と同時に倫理をも社会統治の道具とする概念の及ぼす一般的帰結について、詳細に明らかにした。その成果の一つは、法と倫理を一体化した法体系は、人間の全人的把握を前提するが、そのことが、帝制中国法制の典型であった口供主義を生み、又紛争の拡大化を帰結することを明らかにしたもので、この点については1996年8月中国黄山市で開催された『儒学与中国法文化研究会』において「重視義与中国法文化」という題で報告され、1997年中国にて刊行予定の書(書名未定)に掲載される。二つは、前述の董仲舒の法思想を手がかりに、礼法一体の法思想の基層に自然主義とプラグマティズムとの奇妙な結合が存在すること、それが人と人との関係性の重視を基礎にしていること、手続のアド・ホックな定立を促すことに影響を与えていること等を、明らかにしたものである。関係性の重視、手続のアド・ホクな定立は現代法研究においても注目されているところであるが、その中国的在り方の解明は、その限界を指摘することにもなる。これについては、鹿児島大学『法学論集』の最新号(1997年発行予定)に発表される予定である。
