ヨーロッパ人権条約は、人権を国際的に保障する取り組みのなかで最も実効的であると評価されてきた。本研究は、そうした同条約の実施システムが、どのように形成され発展してきたのかを、同条約の母体機構であるヨーロッパ評議会の職員（国際行政官）の活動に着目して明らかにしようとする。ヨーロッパ人権条約の実施システムは、締約国意思から一定程度自律した空間で国際行政官によって精緻化されているというのが、申請者の見立てである。この目的のために、平成30年度は、とりわけ、関連の一次資料を読み込む作業に従事した。ヨーロッパ人権条約の実施システムの形成・発展を国際行政官（ヨーロッパ評議会職員）に着目して考察する研究がこれまでほとんど存在しなかったことを踏まえると、一次資料を渉猟する作業が欠かせない。その結果、とりわけ、ヨーロッパ評議会閣僚委員会が行っているヨーロッパ人権裁判所判決の執行監視手続の形成・発展について次のことが明らかになった。ヨーロッパ人権条約は、人権裁判所判決の執行監視を行う権限が閣僚委員会にあると規定するのみで、その監視手続については何も定めていない。閣僚委員会は監視のための規則を1976年と2001年、2006年に制定したが、そこでも詳しい手続は定められていない。一方で、現在の実際の監視手続は相当程度充実した密度の濃いものになっている。そして、そのほとんどは、判決執行部に所属するヨーロッパ評議会の職員によって、実践を通してあるいは閣僚委員会の了解を得て形成されてきたのである。このことは、ストラスブールでの現地調査でも確認できた。判決執行部の職員に聞き取り調査したところ、判決執行監視手続に関するほとんどの提案は同部署から行われ、そのほぼすべてが採用されているというのである。ここには、実施システムの発展を専門知識を有する職能集団に委ねるという機能主義的発想が見てとれる。
