This study pursues the establishment of a fundamental theory of protection of vested rights. I refer the German law. First, on the basis of theory of constitutional property rights, I show the relationship between vested rights and institutional guarantee. Second, I examine judgments and literature about reasons for demanding protection of vested rights. Third, I analyze how protection of vested rights is provided in the German legal system. This study can lead to appropriate protection of vested rights.

本研究的目的是建立既得权利保护的基本理论。我指的是德国法律。首先，以宪法财产权理论为基础，论证了既得权利与制度保障的关系。第二，我研究了关于要求保护既得权利的理由的判决和文献。第三，我分析了德国法律的体系如何保护既得权利。这项研究可以导致对既得权利的适当保护。
