Changing Structure of Law and Politics in Contemporary Korea

该项目是由立命馆法学院的成员和首尔大学法学院的韩国法律学者以及其他大学共同开展的为期三年的日韩合作项目。1987年的“6月民主化斗争”是战后韩国的转折点，我们试图阐明近代韩国法律和政治结构的民主化进程。我们研究分析了自卢武铉泰愚政府上台以来，在现代韩国民主化进程中，宪法、刑法、劳动法、行政法、经济法等法律的变化。然后，我们得出结论，司法系统对政治权力的控制逐渐加强，使更多更强大的资产保护人权，建立司法权的独立性，司法改革，公民运动的兴起，公民对政治的承诺增加，更多的cs和正义，如宪法法院的作用和国家人权委员会的建立程序。另一方面，必须指出因国家分裂和独裁主义的后遗症而导致的保留《国家安全法》等对民主化的限制。我们三年的联合研究活动如下：第一届联席会议（1999年4月在韩国汉城举行）上，日本提交了两份报告，韩国提交了五份报告。第二次联席会议（1999年10月，京都）上，日本和韩国分别发表了3篇论文和4篇论文，日本大法院前大法官声部严男先生发表了追悼词。第三次共同研究（2000年6月在韩国庆州）中，日本和韩国各发表了4篇论文。第四次联合研究（2000年12月，京都），日本1篇，韩国3篇。第5次共同研究（2001年5月在釜山举行）中，韩国有3人参加，全体成员进行了全面讨论。三年内共发表论文三十篇。其中9篇论文在《立命馆法律评论》上被翻译成日文。2002年，我们正在以“当代韩国法律和政治结构的变化”为题出版论文选集。少

This project was carried out for three years as Japan-Korea joint project, mainly by members of Ritsumeikan Law Faculty and Korean legal scholars of the college of law of the Seoul National University, and other universities. We have tried to make clear recent process of democratization in legal and political structure of recent Korea after "the June struggle for democratization" in 1987, which was the turning point of post war South Korea. We have researched and analyzed changes of the Constitution, the Criminal Law, the Labor law, the Administrative law, and the Economic law under the democratization process of the modern South Korea after the inauguration of Roh, Tae Woo Administration. Then, we conclude that there are gradual strengthening of judicial system to control political power, making more stronger assets to protect human rights, establishing the independence of judicial power, judicial reform, emerging movements by citizens, and increase of the citizen commitment to politi … More cs and justice, such as the role of the Constitutional Court and establishing process of National Human Rights Committee. On the other hand, it must point out some restrictions against democratization such as preserving the National Security Act, which is caused by division of the nation and the legacy of authoritarianism.The activities of our three years joint research is as follows;In the 1st joint session (April, 1999 in Seoul, Korea), two reports were submitted from Japan and five from South Korea. In the 2nd joint session (October, 1999 in Kyoto), three papers from Japan, and four from South Korea, and Mr. Itsuo Sonobe, the former justice of Japanese Supreme Court, gave the memorial speech. In the 3rd joint research (June, 2000 in Kyongju, Korea), four papers each from Japan and South Korea. The 4th joint research (December, 2000 in Kyoto) one paper from Japan and three from South Korea. In the 5th joint research (May, 2001 in Pusan), three from the South Korea and the comprehensive discussion was hold by all members. Totally thirty papers were presented in three years. Among them, nine papers were translated into Japanese at a series of Ritsumeikan Law Review.
