项目摘要

遺伝子治療をはじめとする先端医療が人間に及ぼす影響は計り知れないものがある。人間の遺伝子の構造分析はほぼ終わったといわれる。ES(幹性)細胞を利用した再生医療が行われ、多くの成果が見込まれている。また、クローン技術が生殖医療に利用される可能性は高いといわれる。いずれも動物実験は終了し、新しい医療への適用が着々と準備されるとともに、医薬品の開発等が現実に行われている。先端医療の是非や方向性が定まらないまま、医療技術が先へ先へと開発され、今や実験段階を超え、実践段階に突入している。これまでは実験室の中での問題提起であったため、医療倫理の問題が検討されればよかったが、今や、周産期医療をはじめとする医療現場へ問題が降りてきたことから、医療技術の法的統制の問題が真剣に議論されなければならない。医薬品の安全性をめぐり法的責任(製造物責任)の帰趨が問題となろう。本研究グループは、専門の医師や法律家の協力を得て、法的統制に関する基礎的研究に着手した。まず、先端医療の関係者から実情を聞くとともに(実情調査)、外国、特にドイツの医学・医療文献情報を大量に集めている(文献調査)。現在、医学的問題点の分析に入った段階であるが(医療関係者による報告会)、これが終了次第、ここで浮かび上がった問題点を、行政法・刑法・民法・社会法のジャンルに囚われない、統合的医事法の観点から分析するための準備を行っている。上と平行して、統合的医事法の開発に携わった法学者の話を聴き、法的統制を行うための基準作りに着手している。また、ケース研究の一環として、先端医療関係の判例や事例を収集し、分析を行っている。このため最新の情報を得るために、多くの医学情報誌を集めるとともに、各国の新聞記事を集めている最中である。インターネットによる検索も欠かせない。
