Pluralistic Structure of Legal Culture in Italy : criminal cases in context

本研究将1890年S至1920年S期间那不勒斯刑事案件的大量卷宗(Fascicoli)置于意大利法律文化的多元化结构中进行分析和语境分析，重点关注1889年《意大利刑法》(1889年)中关于杀害婴儿的条款。2004年7月、8月和2005年3月，在那不勒斯档案馆检索并转录了许多此类案件卷宗，并与意大利法学家联系，特别是多梅尼科·里佐，其关于性别研究的建议具有很强的启发性法西奥7-法西科洛99,1904；Fascio 16-Fascicolo 724,1901)作为对法律制度和法律主体之间相互作用过程的试探性微观分析而出版。此外，四个国家(意大利、法国、德国和西班牙)刑法中关于“原因”的比较历史将在即将出版的书中出版(M.Tanaka编辑)。

In this research, a lot of files (fascicoli) of criminal cases of Naples from 1890's to 1920's are analyzed and contextualized in the pluralistic structure of Italian legal culture, being focused to so-called "causa di onore (causa lionoris)" articles of Italian Criminal Code (1889).In July and August 2004,and in march 2005,many case-files of this kind were searched for and transcripted at the Archivio di Stato di Napoli, in contact with the italian historians of law for the discussion, especially Domenico Rizzo, whose suggetions on gender studies were illuminating so much.Consequently, two case-studies on infanticide (Tribunale penale di Napoli, fascio 7-fascicolo 99,1904;fascio 16-fascicolo 724,1901) are published as a tentative micro-analysis of the interactional process between legal system and legal subject. In addition, a comparative history on "causa di onore" in the criminal codes of four countries (Italy, France, Germany, and Spain) will be published on the forthcoming book (ed.by M.Tanaka).
