Study on Significance of the Intimate Sphere from the view point of the structure of norm : one of most important matter of Domestic Violence

本项目旨在研究亲密领域内的规范结构，以及市民社会、民法、私人和亲密之间的关系。1)从法律和政治思想史的角度对“市民社会”概念进行历史研究，梳理了法律和政治思想史特别是18世纪亲密领域概念的产生和发展过程。今年的任务是解释这一概念在现代公民社会和后现代公民社会中定位的差异，并明确几位专家和专业知识的作用，这是公共领域和亲密领域的封闭问题。2)从市民社会理论出发的理论研究本学期的任务是比较市民社会理论和正义理论对社会结构的理解，明确女性主义的影响，并呈现亲密领域在现代和后现代社会中的意义。3)关于家庭暴力的一些规定及法律制度作用的研究，重点是对家庭暴力的一些新规定和改革进行考察，并与与家庭暴力相关的《跟踪者规制法》和《虐待儿童保护法》进行比较，4)对这三项研究进行调整和安排，该项目的部分成果在法律哲学家年会上公开发表，并在学术杂志上发表。

This project aimed the study on the structure of norm within the intimate sphere and the relationship among the civil society, civil law, the private and the intimate.1) Historical study on the concept of "Civil Society", from the point of history of legal and political ideasI have arranged the appear ance and develop ping process of the concept of intimate sphere from history of the legal and political ideas, especially 18the century. And the task of this year was to explain the differences of positioning this concept in the modern civil society and post modern civil society, and to make clear the role of the several specialists and the expertised knowledge, which was the problem of the closing the public sphere and intimate sphere.2) Theoretical study from the theories of civil societyIt was performed the tasks of this term were to compare the theories of civil society and theories of justice on the understanding the structure of society, and to make clear the influence from feminism, and to present the significant of the intimate sphere in modern and post modern society.3) Study on some regulations over the Domestic Violence and the role of legal systemIt was focused on the investigation on the some new regulation and reformation over DV, and the comparison with the stalker regulating law and protection law of child abuse which is connected DV,4) adjusting and arrangement these three studiesA part of result of this project was made in public at the annual meeting of legal philosophers, and published in the academic magazine.
