A Study on the International Law-Making Process in the Institutionalization concerning the International Public Interests

在本课题研究期间，本人进行了多项与本课题相关的工作。首先，我从为什么人权标准在国际法中被普遍化以及如何证明这种普遍化是合理的角度论述了国际法中的人权保护。第三，我在日本国际法学会年会上以国际争端的公共政策为题发表了演讲，重点讨论了人道主义干预以及如何从共同体利益的角度解决人道主义干预。第四，从保护国际社会整体利益的角度，论述了中立法的特征。最后，笔者写了一篇文章，对国际法中的习惯概念提出了自己的看法。在本文中，我表达了这样一种观点，即应根据国际规则的普遍化的有效性来讨论共同法的存在，因此，在判决中，证明其普遍化的解释性解释是必不可少的。

In the period of this project, I have conducted several works concerning this research project. First, I dealt with the protection of human rights in International law in terms of why the standards of human rights are generalized in international law and how the generalization can be justified. Thirdly, I made an address in the annual meeting of the Japanese Society of Internationl Law under the title of Public Policy of International Disputes by focusing on humanitarian intervention and on how it should be solved in terms of community interests. Forthly, I discussed how the law of neutrality should be characterised in the light of protecting interests of iternational community as a whole. Finally, I wrote an article to put forward my idea about the concept of custom in international law. In the article, I expressed the view that the existence of cusomary law should be discussed in terms of the validity of the generalization of international rules and therefore interpretive construction to justify its generalization is essential in the judgment.
