本研究のテーマは、「現代中国法の歴史的連続と不連続」であるが、現代中国刑事法を中心に研究を進めて来た。まず、研究の視点として、「封建中国法」、「民国期中国法」、「近代市民法」という三つ概念を立てて、その相互関連の中で現代中国法の性格及びその将来を分析した。その結論として、現代中国法は、制度レベルとして、「民国期中国法」と同じく、「封建中国法」に対する否定であって、より「近代市民法」的なものとなっており、この方向性が今後も増大する、という結果に至っている。次に、法の評価は、制度としてのみならず、結果レベルでも見る必要があるとして、「制度としての法」と「結果としての法」という二つの概念を作って、「結果としての法」から見れば、「現代中国法」は「近代市民法」から問題視されるところがまだ多いことを示唆した。最後に、「現代中国法」の将来は、文化建設などの結果重視的方策にかかっていると結論づけた

This study is entitled "The History of Modern China Law" and "The Center of Modern China Criminal Law." The three concepts of feudal China law, Republic of China China law and modern citizen law were established. The character and future of modern China law were analyzed. Conclusion: Modern China Law, System, Republic Period China Law, Feudal China Law, Negation, Modern Civil Law, Direction, Future Expansion, Result. Second, the evaluation of law, the system and the law, the result and the necessity, the system and the law, the result and the law, the modern China law and the modern civil law. Finally, the future of "Modern China Law" and the policy of cultural construction should be emphasized.
