本研究によって、「大学教授資格試験」のやり方について、以下のことが明らかになった。私講師になって大学の教壇に立とうと思う者は、ハビリタツィオンとよばれる大学教授資格試験を受けて「教授資格」を取得しなければならない。教授資格を取らずに私講師になる方法はなかったから、私講師志願者は教授資格試験を受けて、教授資格を取得するほかはなかったのである。志願を許可された者は試験講義を行わなければならない。そのテーマは学部から与えられるか、志願者が学部の同意を得て選ぶかのいずれかによって決められるテーマが決定してから4週間の猶予が志願者に与えられる。試験講義が終わると志願者は教授の行う口頭試問を受ける。その後、私講師として講義することを認めるか否かが学部教授会の多数決によって決定される。会議の結果は学部長がこれを本人に通知する。「大学教授資格試験」で重視されたのは、専門分野の論文であって、口頭発表能力や講義(教授)能力ではなかった。しかしながら、この試験のやり方をみて、われわれが気づかされることは、(1)志願者の研究能力のみならず、形式的にではあったにせよ、教授能力が試されていること、および、(2)志願者に教授資格を授与するか否か、さらには私講師として採用するか否かはひとえに学部の自由裁量に委ねられていたということである。私講師になることを認められた者は公開の就任講義を行なう。そのために3ケ月の猶予が与えられる。ベルリン大学の学則の規定からも明らかなように、私講師の養成と採用は、国家の関与する公の領域から全く独立して、伝統的な自治団体の原理にもとづいて行なわれていた。私講師の補充権は学部に属していたのであって、国家に属していたのではなかった。
