1.まず西ドイツにおいては、1985年に連邦会計検査院法が改正され、検査院は一層議会へ近寄せられ、今や、議会と政府の中間に立って、双方のために活動する特別の財政コントロール機関と捉えられるようになった。また、検査権限は決算の検査ばかりでなく、広く国の予算や経済の運営にまで及ぶものである。その際、検査基準としては「経済性基準」が最も重要であるが、その内容は経済学上の経済性概念によりかかっている。そのため、検査院は非常に抽象的な基準で強いコントロール権を行使するので、たとえ検査報告には法的拘束力がないにせよ、その影響力は非常に大きい。そこで検査権の限界が重要な問題となるが、最大の争点は政治的決定にたいして検査権を行使できるかどうかである。しかし西ドイツでは伝統的な検査院の非政治性のドグマに批判がなされ、経済性基準の下では原則的には政治的決定にも検査は及ぶとされ、但しそれは自制すべきことと解されている。さらに権利保護の問題については、検査報告全体を争う時は憲法争訟で、報告の部分的撤回を求める時は行政訴訟の給付訴訟で、さらに検査の通知にたいして、それを処分と捉えて行政訴訟の取消訴訟で争うことを認める判例や学説が例外的ではあれ登場してきた。しかしこれらの争訟手段のうち、行政訴訟は1985年の改正法により、検査院の検査手続には連邦行政手続法は一般的には適用されないとされたので、使用困難になったといえよう。2.日本の場合には、本研究は、憲法90条の改正なしでも、西ドイツと同じく、検査報告を政府へと同時に国会へも提出できること、また経済性基準により、決算の検査に伴って広く行政の運営にも改善要求の形式等で検査院は介入できることなどを明らかにした。以上のような研究をふまえて、今後は、アメリカやカナダおよびイギリス等の会計検査院の研究を推進したい。
