1.本年度の研究実施計画は, 難民の大量流出に伴う本国(難民の国籍国)の受け入れ国に対する国際法上の国家責任を認めうるか否かについて, (1)問題の所在の明確化, (2)具体的ケースの分析, (3)関連学説の検討, であった.2.本年度の主な成果は, 次の二点に大別することができる.(1)1980年から1986年までの関連する国連の第一次資料を収集・分析することによって, 1)この問題が国連で取り上げられるにいたった背景2)本主題るおける伝統的「難民」の法的定義の非妥当性3)大量難民流出をもたらす政治的及び自然的原因と社会・経済的諸要因の存在, それらの内容および相互の複雑な交錯性, について新たな知見を得た.(2)関連の学説を分析することによって, 1)政治的に且つ意図的に大量難民を流出する国家政策の遂行は, その合法性が国際法上疑わしく, 2)そこでは, 従来の人道的・人権保護のアプローチではなく, 国際法の基本原則に基づく国家責任追及のアプローチが必要であり, 3)難民の国籍国に対して, 理論上いわゆる領域管理責任原則に基づく違法行為責任を追及しうること, さらに4)領域管理責任原則を基礎に国際協力義務の履行を関係国に要求しうる(この協力義務の内容については, 国連国際法委員会が現在作成中の越境損害の発生の防止・賠償に関する条約草案で具体化されるはずである), との一応の結論に達した.3.今後, この研究のまとめの段階に入るが, 本年度には必ずしも十分に検討することができなかった具体的ケースの分析を継続, 完了することによって, 研究成果の公表は次年度に行う予定である.

1. (2)Analysis of the theory of correlation: 1) Political and intentional reasons for the large number of refugees flowing out of the country, the implementation of the national policy, the legality of which is doubtful in international law, 2) Humanitarian reasons for the protection of the human person, the basic principles of international law, the responsibility of the state and the necessity of the refugee, 3) The nationality of the refugee Theoretically, the principle of domain management responsibility is based on the responsibility of illegal acts. 4) The principle of domain management responsibility is based on the obligation of international cooperation. 3. In the future, this research will be carried out at different stages, and this year, it will be necessary to carry out detailed analysis of the draft treaty on prevention and compensation of transboundary damage. The results of the study are scheduled for the next year.
