社会保険給付と損害賠償との調整にあたっては, 被害者・加害者間の示談とともに, 社会保険者の求償権が重要な役割をはたすことになる. 本研究は, 西ドイツの社会保険における求償権の理論的展開をフォローするとともに, 求償権が実務上どのように行使されているかについての調査研究を行うことを目的とするものであったが, 以上の問題意識に立って, 次の研究を行った. 1.西ドイツの社会保険(労災保険を含む)における求償権の法理論的検討について西ドイツでは, 従来, 第三者災害に関する社会保険給付と損害賠償との調整は, ライヒ保険法(RVO)1542条で規制されていたが, 1983年7月1日以降の災害については, 社会法典(SGB)10編116条以下によって規制されることになった. 新立法は, 従来の社会裁判所の判例を明文化するものであるが, 従来から学説上批判のあった社会保険者の求償権に関する配分優先権を否定するなど新しく規制された部分も含んでいる. この点は, わが国の同種の問題を考えるうえでも示唆するところが大きかった.2.わが国の求償権をめぐる裁判例と実務上の取扱い下級審では, 一部に, 当事者の示談によっても保険者の求償権は否定されないとするものがみられたが, 最高裁はこの点を否定している. わが国の社会保険の実務では, 立法上, 求償権保護の明確な規定がないこともあって, (1)損害賠償の支払いを優先させる, (2)求償権行使の期間を, (とくに年金給付については), 一定期間に限る, などの取扱いを行っている. これが妥当かどうかは, 社会保険・労災保険の年金給付をどう評価するかととも関連する難しい問題であるが, 立法論的にはなお検討を必要とする問題である. 実際の具体例にあたって追跡調査もしてみたかったが, これについては, 又の機会に行いたいと思っている.

Social security payments and compensation adjustments, victim and offender, social security claims and compensation adjustments This study is aimed at the development of the theory of social security claims in the West, and the investigation and study of claims in practice. 1. Social Security Law (RVO) Article 1542 of the Social Security Law (RVO) regulates the payment of social security claims and the adjustment of damages in relation to third party disasters, and regulates the payment of damages in relation to disasters falling since July 1, 1983 under Article 116 of the Social Code (SGB). The new legislation is aimed at clarifying the legal precedent of the social tribunal, criticizing the theory of social protection, and denying the priority of distribution of compensation. The point is that the claimant of the party concerned is denied the claim of the party concerned, and the highest court is denied the claim of the party concerned. In practice of social security of the country, legislation clearly stipulates the protection of claims, (1) priority of compensation for damages, (2) period of claim exercise, (3) limitation of pension payment, and implementation of claims. The problem of social security, disaster protection and pension payment is difficult to solve, and the problem of legislative discussion is necessary. In fact, the specific example of tracing investigation is to trace the investigation, which is to trace the investigation, and to trace the investigation.
