项目摘要

オーストリア第一共和制における1929年の憲法改正のプロセスを明らかにし、この憲法改正の主要目標のひとつであった憲法裁判所改組問題の解決の仕方を実証的に分析するとともに、1920年代の国際的・国内的情勢が、ハンス・ケルゼンの法観・国家観にいかに影響をあたえたかを考察する、という目的の第一段階が、今年度の研究であった。したがって、今年度は研究全体の導入部分にあたる。具体的にいえば、1920年憲法制定以降の憲法改正の動きであり、それを次のような論点にそくして明らかにした。1.1920年憲法制定にかかわる社会民主党とキリスト教社会党の妥協。2.1920年憲法における議会主義と連邦主義。3.1920年憲法にたいする諸政党の態度表明。4.1929年までの政治状況の変化と憲法改正の動き。5.憲法改正要求の対するケルゼンの対応。引き続き、国民議会における、特に憲法改正委員会における各政党の議論を明らかにするとともに、これにかかわってケルゼンが展開した法理論の分析を行うつもりである。1929年憲法改正によって憲法裁判所は「脱政治化」されたのであるが、その直接的要因は、政府・与党に対する憲法裁判所の批判的姿勢にあったのではないか、また、憲法裁判所のそのような態度はケルゼンによって代表されたのではないか、などの疑問とともに、オーストリアにおける反ユダヤ主義運動はケルゼンとどのようにかかわったのか、という疑問の解明にも視野をひろげてみた。
