本研究は,「萌芽的研究」として,公法学的「行政国家」論の発展・再編を大目的とし,そのために,「ネオ行政国家」概念の仮設と検証,公法学的「ネオ行政国家」論への着手,という二つの作業段階を設定した。当初2年計画で申請したが,平成2年度の単年度についてのみ補助金交付が認められるにとどまったので,できるだけ基盤的な考察・調査に重点を置くこととした。すでに事前の予備研究で,「行政国家」の概念と理論を,発想を思い切って転換することにより,「ネオ行政国家」の概念と理論へと弁証法的に発展・再編すべきことの着想を得ていたが,この1年間の本格研究を通して,さまざまの文献的・資料的デ-タから,従来の機関的・単核的「行政国家」化が機能的・多様的「行政国家」化へとベクトル変換を来しつつあることの理論的・実証的裏づけが,かなりの程度遂行できたと思われる。その過程で,当研究の前提を成す「行政」および「行政国家」の概念装置につき,最新の内外の学界動向に徴し,さらには直接手島説に対して加えられた諸批判への反批判という形で,根本的な再検討をも行なった。これらは,次々欄(11)所掲3篇の学術論文として既に発表されている。以上の「ネオ行政国家」論は,体系的にまとめられ,今年中に単行出版される(『ポスト現代国家ーその論理と法理ー』出版社交渉中)。なお,「ネオ行政国家」において新たに発生する個別具体の公法的諸問題についても,行政責任の実効的確保の新体制など,鋭意思索を凝うしてきたが,その一応のまとめは,今夏に完稿予定の共著書(手島孝=中川剛『憲法と行政権』法律文化社発行)によってなされる。
