本研究は,労働法上労働者に保障されている権利が、訴訟において実際にどのように実現されているのか、またその際の問題は何かを、「過労死」の事件を通じて実証的に検討しようとするものであった。研究は2つの柱でなされた。第1は、訴訟の前段階である行政官庁への労働災害の認定申請手続についての研究である。平成元年度中に労働保険審査会で決定が下された事件が37件あったが,これについて、(1)事故発生から労基署長の処分、審査官の決定,そして再審査決定までに要した日時,(2)事故時の労働条件の内容,(3)申請手続での会社および労働組合の協力の有無,(4)医師の診断書の内容等の側面から分析した。ここでは特に、申請手続は遺族が個人として為し、労働組合の助力が全く得られていない、という問題が指摘できる。第2は、既に判決が下されている事例についての研究である。東京での2事件、名古屋での1事件を抽出し、原告本人と訴訟担当弁護士からヒアリングを行なう形で研究を進めた。調査項目は、(1)訴訟を提起するに至った経緯、(2)訴訟を遂行する際の生活上の困難、(2)資料収集の困難,(4)労働訴訟における労働組合の役割,(5)同じく弁護士の役割についてである。ここでも,訴訟が発告個人と弁護士との大きな負担となり,労働組合がほとんど関与していない,という問題が浮かび上がってきた。今後さらに,労働訴訟における以上の問題についての比較法的研究も進めて行き,その成果をまとめたいと考えている。

This study aims to investigate the legal protection, litigation implementation, and other issues related to "death" through the investigation and verification of cases. The study of the two columns was carried out. The first step is to study the application for disaster identification by the administrative officer. In the middle of the first year of Heisei, 37 cases were decided by the Health Protection Review Committee, including: (1) the punishment of the Director of the Health Protection Bureau, the decision of the review officer, and the important date of the review decision;(2) the content of the conditions for the accident;(3) the existence of cooperation between the organization and the organization of the application; and (4) the bottom analysis of the content of the doctor's diagnosis certificate. Tokyo 2 Incident, Nagoya 1 Incident, Plaintiff, Lawsuit Officer, Nurse, Case Study The investigation items include: (1) the duration of litigation;(2) difficulties in life during litigation;(2) difficulties in data collection;(4) the duration of litigation; and (5) the duration of litigation. The lawsuit is filed against the individual, the nurse, the burden, the combination, the problem, the floating problem. In the future, the study of comparative method of litigation and litigation should be carried out and the results should be studied.
