1.資料集めについては、1950年代以降のものについて広く実施し、相当の成果を得た。ただし量的にはやはり80年代のものが大半を占めており,50年代のものは容易に入手しえなかった。しかし、わずかではあるが50年代後半の立法関係の資料を入手したので,これを足掛りに周辺資料の入手に努め、もっとも解明が遅れている50年代後半から60年代後半へ至る時期の,制度上の変遷について分析を進めてみたいと考えている。2、以上のような状況のため、今年度の研究は89年における法改正の問題が中心とならざるをえなかった。これに関連しては相当量の資料を入手することができたので、年度内に研究成果の一部をとりまとめ、公表することができた。資料の入手にあたっては中国司法部(法務省)の援助を受け、貴重な資料を送ってもらうことができた。今年度は日本人研究者からのヒアリング、基礎資料の翻訳などを実施したが,中国司法部からの協力の申し出もあるので,来年度以降は現地調査,中国人研究者もしくは実務担当者などからのヒアリングなども実施してみたい。3、80年代の制度改革については一定のとりまとめをおこなえたものの、50年代〜70年代についてはとりあえず資料を収集しただけで,内容上の検討を進めることはできなかった。この時期の資料収集には相当因難がともなうが,中国社会料学院法学研究所の協力を得られることになったので,今後はこの時期の研究を進め,既存の研究(40年代〜53年および今年度の80年代)の欠落部分を埋めて、全体的なとりまとめができるよう準備したい。
