今年度は、職務共助の理論的基礎の一つである行政の一体性の観念について検討、我国実定法制度における行政共助の取り扱われ方、及び一自治体における研究課題に関連する実態調査を行った。職務共助の理論的基礎としてしばしば指摘されている行政の一体性の法的な意味についてに検討は、特に、我国では十分行われてきていないのであるが、例えば、ドイツを例にとると、その歴史は18世紀末の帝国国法論者に、その嚆矢を見いだすことができる。行政あるいは国家の一体性という観念は、様々な要因と結びついた多義的な観念であるが、19世紀の初頭には、行政の専門的種別化に対応した組織の一体性の確保という、組織上の概念としての一体性という用いられ方が存在している。19世紀の中葉意向の実証主義的国法学においては、一体性という観念から何らかの規範的要請を導き出すということには至らず、また、行政学においても、行政の一体性は、地域原則を指すという理解が行われた。行政法学においては、組織原則としての行政の一体性は、行政の階統制原則として理解されてきた。自由主義的法治国家観の下での行政組織権理論、行政の一体性の要請及び権限分配原則との関係は、きわめて興味深いものである。また、この様な行政の一体性についての理解は、戦後の民主主義的法法国家観の下では一定の修正を受けざるを得ず、新たな議論の展開を見ることができる。我国の実定法制度をみると、学術情報センタ-の法令デ-タベ-スを用いた検索結果だけを見ても、国家行政組織法をはじめとしてきわめて多くの行政共助に関する規程をみることができる。しかし、法的には、自発的な共助の場合の責任分担等、検討されるべき点の多いことが、改めて明かとなった。道路交通警察上の権限を有する警察官庁と道路管理権を有する行政機関との行政共助に関し、若干の自治体の実態調査を行ったが、条例の授権のない行政共助の例がみられた。権限の融合や計画の総合調整機能といった現代的問題との関連など、本研究課題の守備範囲とも関わって、なお、残された課題が多いと言わざるを得ないが、上記の研究成果に関しては、逐次、次年度に公表する予定でいる。
