项目摘要

1 我国の英米法研究の空隙分野とも言える、アメリカ法の歴史分析を、その法曹制度の特殊性に着目し、イギリス並びにアメリカ各地域間における比較の観点を重視しつつ、現行英米法学に対する基礎研究として行っている。 2 その一環として、先に独立前のマサチューセッツ法曹制度を考察したのを継承し、今年度は独立前ヴァジニアの法曹制度を中心に検討した。その結果、以下の諸点を明らかにすることができた。(1)マサチューセッツの法曹制度は、立法などの中央集権的方法によるのではなく、各裁判所が個別にかあるいは民間の弁護士の集団が独自に規制を行うという傾向が、時代が下がるにつれ顕著になるのに対し、ヴァジニアでは、基本的に、立法による中央集権的ないし一元的な方法が、独立に至るまで一貫して法曹規制の中心をなしていること。(2)マサチューセッツではとりわけ「法律家団体」と呼ばれる弁護士集団が自律的に、法曹資格要件や法学教育に密接に関与し、イギリスにおけるバリスタ集団たるインズ・オブ・コートに類比される、法曹の「イングランド化」を、リ-ドしたとされるのに対し、ヴァジニアにはかかる団体は見られず、法曹資格認定はここでも立法の定めに基づく「法曹資格試験」によるものとされていること。(3)ヴァジニアの法曹資格試験は、弁護士資格を政治的・社会的上流階層にのみ付与する形で運営される傾向が強く、従って法曹の客観的資質を高める意味での「イングランド化」には資するところが少ないこと。以上である。 3 同じアメリカ内にあっても、植民地ごとにかくも異なる法的制度を有していたという、我国では殆ど意識されない点を明らかにしえた。今後は研究の対象時代を独立後に移し、かように異なる制度を蔵していたアメリカ諸邦が連合した結果、いかなる新たなアメリカ型の法曹制度を形成するに至ったかのかを中心に、更に法制史的研究を続ける計画である。
