平成4年度の「アメリカ連邦刑事訴訟規則の立法過程:当事者モデルの神話と実像」に引き続いて、刑事訴訟法の指導理念である当事者主義あるいはこれを基礎とした当事者モデルの捉え直しを目的として、本年度は、一見、職権主義的な訴訟行為である裁判所の処分を根拠付ける「司法の監督権」につき、アメリカの諸判例を検討した。コモン・ロ-では、裁判所に固有の権限があるとされ、実定法に明文のない場合の裁判所の様々な判断の根拠とされてきた。しかしながら、抽象的な固有権論からより直せつな司法の「監督権」概念が合衆国最高裁判例において今世紀に確立するに至る。司法の監督権は、司法による刑事司法制度における統制(制御)機能として働くが、具体的には(1)司法手続の質の保護、(2)制定法違反の適示、(3)不当な場面での救済、の3つの役割を持っていることが判例上確認された。また、合衆国最高裁が1983年に示したように、司法の監督権の政策的目的と倫理的目的のふたつの実現は、コモン・ロ-との沿革を異にするわが国にも充分適用可能な観念であることを発見した。こうした裁判所の権限によって、当事者モデルでは対応しづらい「証拠開示問題」や「証拠排除問題」への論拠をかなり明確に主張しうる理論的基盤を整えることができるとの知見を得た。

In 2004, the "Legislative Process of Criminal Procedure Rules of the United States: Myth and Image of the Parties" was cited, and the guiding principles of criminal procedure law were discussed. The court's decision is based on the theory of "evidence discovery" and "evidence exclusion".
