项目摘要

理論研究については,ケルン大学教授トーマス・ヴァイゲント氏が予定どおり4月に来日し,7月初めまで滞在したので,ドイツ刑事手続法の最新の発展について全般的にその見解を聞くとともに研究グループのメンバーが頻繁に同氏と接触して多くの知見を得た(また,同氏に対して日本法の動向を説明した)。とくに最近の問題点として,隠密捜査官や情報提供者を利用する捜査手法があるが,ドイツ国内における状況について具体的な知見を得ることができた。ヴァイケントの提供した説明のうち一般的なものについては,近く法律雑誌に連載して日本に紹介する予定である。法典の翻訳については,分担して作業を行い,すでにその大部分を完了しているが,なお細部にわたって調整中である。分担は,第1編「総則」及び第2編第一審手続」松尾,第3編「上訴」,酒巻,第4編「確定判決により終結した手続の再開」松尾,第5編「被害者の手続参加」長沼,第6編「特殊手続」大澤,第7編「刑の執行及び訴訟費用」及び第8編「全国検察手続登録簿」佐伯であるが,第1編及び第2編については,専修大学教授日高義博氏の参加も得ている。印刷公表に関しては,現下の出版事情に照らして困難も予想されたが,ようやく見直しがつき,あまり遠くない時期に全文を刊行できる見込みである。
