项目摘要

今年度は、6月に韓国の韓日関係史学会において、「韓国の西洋法思想受容と兪吉濬」というテーマで、兪吉濬の著書のなかでも、特に福沢諭吉の『西洋事情』と同一の内容を多く含む『西遊見聞』および東京大学で教鞭をとったKarl Rathgenの講義録の翻訳であるといわれる『政治学』を素材に兪吉濬の西洋法、特に憲法思想受容の特徴を考察した。その結果、かれの叙述には社会的ないし歴史的要素が権利,法、国家の形成要素として非常に重視されているという特徴があることがわかった。この特徴は、かれの儒教的思想基盤が西洋法思想受容過程において、特にドイツ歴史学派の法思想とうまく融合されるための機能を果たしたのではないかと思われる。また一月には、韓国の法史学学会において「兪致衡と穂積八束」というタイトルで報告を行なったが、これは日本で発表したものを改編したものである。なお、今年度は昨年度からの継続で、韓国第一共和国憲法の制定過程および同憲法の原案を作成したといわれる兪鎭午の憲法思想を考察することを主たる作業とした.特に、韓国に滞在する機会が数回あったため、当地の研究者たちにインタビューをしつつ、研究を進めた。インタビューに応じてくれたのは、ソウル大学崔鐘庫教授(法思想史)、延世大学柳永益教授(韓国史)、ソウル大学金哲洙名誉教授(憲法)、延世大学兪浣教授(都市工学、兪鎭午博士子息)、仁荷大学李京柱教授(憲法)、明知大学金学俊教授(政治史)、東亜大学金孝全教授(憲法、法思想史)、ソウル大学李映録博士(法思想史)の各氏である。これらのインタビューを踏まえた資料分析のなかで第一共和国憲法の制定過程ではドイツ(特にワイマール憲法)やアメリカの憲法思想の影響のほか上海臨時政府時代の憲法を通じて、中華民国憲法の影響も見られること、またそこに現れた民主主義思想には民族主義との結びつきが見られることがわかった。
