本年度は昨年度に引続きドイツにおけるソフトウェアの強制執行について研究した。ドイツの強制執行手続と日本の民事執行手続は類似する点が多い。ソフトウェアに関する強制執行も換価手続きにおいて実質的に類似することが多いことがわかった。金銭債権に基づく差押さえの可否に関しては、ドイツ民法典(BGB)90条の「物」の概念から導くのではなく、ドイツ民事訴訟法(ZPO)808条の趣旨により動産の差押さえに準じてなされることになっている。また、ドイツにおいて著作権は譲渡禁止であり、利用権に関して差押さえができる。換価方法としては、取立てに代わる移付がとられる。ソフトウェア引渡しの強制執行における債務名義の特定性はステップ毎の特定を要求する見解もあるが、判例は定まっていない。特定の際にはソースコードが重要になり、債権者が所持しない場合には物の占有者に対する提示と検査請求権を準用すべきとする見解がある。米国においてソフトウェア・ライセンス契約の統一法として起草作業が進められていたUCC2B編は、コンピュータ情報取引法UCITA(Uniform Computer Information Transaction Act)として全米統一州法会議(NCCUSL)により制定された。UCITAにおいて強制執行に関連する事項として、電子的自力救済の規定が存在する。電子的自力救済は、ライセンス期間の終了やライセンス契約に違反する場合に、プログラムの使用が自動的にできなくなる仕組みをライセンサーが取りうるというものである。差し止めの仮処分よりも前にライセンシーの利用を禁止することができる。ただし、電子的自力救済は、生命や公の安全にかかわるようなプログラムに対しては利用できず、また、当事者の合意を前提とし、かつ事前の通知を必要とするかたちで制限的に認められている。
