本年度の研究においては、不干渉原則についての諸国間の実践の歴史的展開を検討した。その結果まず第一に、「干渉」概念に二つの見解が歴史的に存在することが明らかになった。19世紀のヨーロッパ国家実行では、不干渉原則とは、他国の内乱状態を前提に、その内乱に対して中立的立場を取ることを意味し、したがって干渉は、他国の内乱の帰趨に影響を与える行為を意味した。これに対して20世紀以降の国家実行においては、干渉とは他国の政府の意思の強制を意味すると捉えられるようになった。しかし前者の干渉概念も、例えば「政府の要請・同意による干渉」といった表現に明らかなように、国家実行から消滅したわけではなかった。このような、二つの異なる干渉概念の並存が、現在しばしば問題とされる干渉概念の不明瞭性の原因のひとつとなっていることが明らかになった。第二に、不干渉原則の制度内容の規律には、諸大国の覇権の要請、すべての国の主権平等の要請、そして国際法の実現の要請という三つの原理が働いていることが明らかになった。19世紀ヨーロッパの国際秩序は、ナポレオン後の戦後処理の諸条約を中核とするものであり、「ヨーロッパ協調」と呼ばれる五つの大国の優越的地位が承認されていた。干渉もこの列強の優越的地位に基づいて規律されており、主権平等の要請はほとんど省みられなかった。また、「ヨーロッパ協調」は、ヨーロッパ公法の履行を実現することを目的とするものであり、列強の優越的地位の要請は、同時に国際法の実現という要請も満たすものでもあった。これに対して20世紀にはいると、特に中南米諸国によって、諸国の絶対的平等の要請のみに基づく不干渉原則の規律が要求されるようになり、1930年代に干渉の絶対的禁止を規定する諸条約が米州諸国で締結されたが、他方で国際法の実現という要請に基づく一定の干渉の合法性の主張も引き続き存在することが明らかになった。
