「規範的規準(規範事実)」を確定するために必要となる専門的な情報の収集・評価の手続について、ドイツ法の独立証拠調べ手続と鑑定手続について検討を行った。ドイツ法の検討から、専門的知見が問題となる民事紛争事件(たとえば、欠陥住宅をめぐる建築事件や医療過誤事件など)では、提訴前の段階において、当事者が、紛争相手方や第三者から、専門的な情報を収集するための手続を拡充しておくことが、訴訟手続によらない紛争の自律的な解決(ADR)、および、訴訟手続における争点整理の効率的な進行のために必要となることが明らかになった。提訴前の情報収集手続について、「証拠へのアクセス拡充をどう図るか」という論文(後述11.参照)を公表した。また、規範事実について適用されるべき審理原則の内容についての検討も行った。その結果、規範事実について、弁論主義が適用される包摂事実とは異なり、自白法理(とりわけ、裁判所に対する審判権排除効=弁論主義の第二テーゼ)は適用されるべきではないということが明らかになった。これは、規範事実(例えば、医療水準)が、他の同種の事件について規範性を有しているため、当事者の処分に委ねるべきではないことに起因している。規範事実について適用される審理原則の具体的な内容を論じるための基礎的な作業として、「民事訴訟における自白の撤回の規律について」という論文を公表した(後述11.参照)。
