本年度も、1920〜40年代の刑法改正事業に関する史料の収集とその整理・解析に力を注いだ。収集した史料のうち重要なものとしては、司法官僚・泉二新熊の遺した史料(中央大学図書館所蔵)、行刑官僚・正木亮関係の史料群(矯正図書館所蔵)のうち刑法改正に関するもの、などである。三年間にわたる収集作業により、改正事業の途次で作られた様々な草案・対案類と会議資料類を、ほぼ網羅することができた。また、陸海軍刑法・監獄法等、関連法令をに関する史料も収集できた。史料収集により本テーマをめぐる基本的な史実を明らかにすることはできたが、論文などの形にまとめるには至らなかった。だが、今後深化すべき課題と論点は明確にできたと考える。一つは、昭和戦前期の監獄法改正事業と刑法改正事業がこれまで考えられていた以上に密接に関わっていたという事実である。両者は、泉二という官僚を結節点としてリンクしていた。とくに昭和初期においては、監獄法改正事業の方が、積極的な刑事政策の志向という点では刑法改正事業をリードしていたといえる。この点に関しては、基本的な史実と経緯を明らかにすることを中心的な課題とする論考を準備中である。二つめは、治安法制との関係である。刑法改正事業上の論点の一つとして、内乱・外患罪等の治安に関係する罰条の改正という点があった。また、一般に戦前期の刑法改正事業は実際の立法に結びつかなかったと思われているが、1941年に成立した刑法一部改正は同事業での草案を基礎にしたと言われている。そして、この改正の一眼目は「安寧秩序ニ対スル罪」の新設であった。ここからも窺えるように、刑法改正事業は(とくに昭和戦前期の)治安法制のあり方に大きな影響を与えていたと考えられる。この論点からみた刑法改正事業像を描く必要がある。上記の点を中心に、本研究で得た知見を今後も継続的に発展させていかなければなるまい。
