项目摘要

本研究の目的は、「電子政府」、「電子自治体」を構築するにあたって発生するであろう法的諸問題をいかに解決し、どのように制度設計すべきかを検討すること、及び、そのような検討をふまえた上で、情報化時代における「行政組織」の内実を分析することにある。平成16年度は、このような目的に沿った調査を行い、考察するにあたり、とりわけ、近時の行政制度改革の中でも注目を集めている行政計画・行政立法手続との関連からこの問題を検討することとした。手法としては、コンピュータ機器を利用した調査・情報収集や、各種文献による調査と検討、必要に応じて関連団体、組織、関係者へのヒアリング等を行った。成果としては、法政大学社会学部にて「電子自治体の諸問題」というタイトルでのレクチャーを1回、また、本研究を発展的に展開させた形で2004年10月公法学会の報告(「行政立法-伝統的二分論に立ち戻って」)を1回行った。また、総務省プライバシー研究会、総務省行政法総論に関する研究会、日野市市民自治研究会といった各種研究会・勉強会への参加、地方公共団体(埼玉県三郷市、神奈川県横須賀市等)での研修やシンポジウムで本研究で得られた知見に基づくプレゼンテーション、等を行った。2004年度公法学会での報告は、直接的には行政立法に関する報告であるが、本研究における検討がその基幹的・基礎的な調査として構築されたものである(2005年に学会誌に掲載の予定である)。

The purpose of this study is to solve the problems of "electronic government" and "electronic autonomy" in the construction of "administrative organization" and to analyze the internal structure of "administrative organization" in the information age. In 2016, the Ministry of Finance and the Ministry of Finance conducted an investigation into the administrative system reform in recent years, focusing on the administrative plan, the administrative and legislative measures, and the related issues. Methods: Research, information collection, research and discussion of various documents, necessary research, organization, relationship, etc. The results of this study were published in the report of the Public Law Society (October 2004) entitled "Issues of Electronic Self-government" by Faculty of Sociology, Hosei University. In addition, participation in various research meetings and conferences of the Ministry of Foreign Affairs, the Ministry of Foreign Affairs Research Association, the Ministry of Foreign Affairs Research Association on Administrative Law, the Hino City Citizen Self-Government Research Association, and local public organizations (Mitsuya City, Saitama Prefecture, Yokosuka City, Kanagawa Prefecture, etc.) will provide basic insights into this research. The 2004 report of the Public Law Society is a direct report related to administrative legislation, and the basic investigation and construction of this research (as determined in the Journal of the Society in 2005).
