本年度の研究は、以下のように進めた。(1)決済における無権限取引についてわが国の学説・判例の検証無権限取引に関連する日本の文献・判例を、網羅的かつ総合的に検証するという視点から整理し、現在のわが国の学説・判例の到達点を明らかにしようと試みた。以前よりすでに進めていた手形に関する部分について判例・学説の整理および検討を行い、昨年度は「手形の偽造と損失の分配-UCCにおける法的処理を中心として-」(法学新報108巻11・12号125-147頁)において、その結果を論文の形でまとめることができた。本年度は昨年度に引続き、振込、電子決済あるいは電子マネーに関する部分について、その法的性格をめぐる議論に関し調査・検討を行った。これについては、比較法的視点も加えた上でまとめることを予定しており、引続きわが国における立法動向の調査も行う予定である。(2)比較法的視点からの研究本年度も昨年度に引続き、アメリカ法、ヨーロッパ諸国の各国法、EU法および国連国際商取引法委員会において作成されている各種条約等に関する資料収集を適宜行っており、その分析も段階的に行っている。このうち、手形に関する部分については、アメリカ法の調査・分析および判例の検討を行い、前述の論文の中でその成果の一部を発表することができた。また、電子的資金移動に関しては、資料を入手できたアメリカ法(特にUCC第4A編)を中心に分析を行っている。なお、アメリカ法に関しては、本研究に関連する部分につき、改正作業が進められておりその動向は流動的であるため調査が難航している。また新たにCheck21と称される法案の検討も進められているようであり、決済におけるチェックトランケーション法制の改正も予定されているようである。この法案の進捗状況によっては、これまでの法制に大きな変更がある可能性もあり、その動向を注意深く見守っている。

The research, analysis and case study of this paper are part of the discussion, and part of the results of the paper is presented. The central analysis of electronic capital movement is based on data analysis (UCC Part 4A). This study is related to some of the problems involved in the investigation.
