本年度は昨年度収集した資料及び情報をもとに下記のような研究を行い成果を得た。1.我が国の実務(1)ヒアリング我が国の実務動向を探るため、株式会社商事法務NBL編集長石川雅規氏の協力を得て、関連会社にヒアリング調査をするための準備作業を行った。現在、質問事項の細かな調整を行っている最中である。(2)我が国の判例研究また、昨年度に大成ユーレックの深田氏から得られた助言をもとに、売買法と請負法の交錯領域である製作物供給契約について研究を行った。具体的には、これまでの我が国の判例について収集分析を行い、請負契約と売買契約との実務における相違点を浮き彫りにした。これまで、我が国においては売買契約が契約法研究の中心とされ、請負契約についてはあまり研究がなされてこなかったが、今回の判例研究から請負契約研究の重要性がより一層明らかとなった。その成果の一部は、NBL誌上(研究発表参照)において報告済みである。また、詳細な分析結果については、駿河台法学18巻1号にて公表の予定である。2.国際的な取り組みについてドイツでは請負法も含めた債務法について改正が行われた結果、2002年1月より新債務法が施行されている。そこで、ドイツの施行後の問題点を調べるため、本年度もドイツ・ミュンヘン大学リース教授にヒアリングを行った。そこでは、性急な法改正の結果、施行後も実際上さまざまな問題点が浮き彫りとなっているという発言を得た。そして、我が国では充分な議論をふまえての改正が必要であるとの助言を得た。また、昨年度・本年度と収集した情報・資料を分析し、ドイツ債務法はどのような経緯で改正が行われ、その中で請負法はどのような改正がなされたのかという研究を行った。その研究成果の一部は、すでに駿河台法学17巻1号にて公表済みである(研究発表参照)3.まとめ以上のように、本年度は、昨年度の調査から明らかになった問題点を検討した結果、その一部を研究結果として公表することができた。しかしながら、残された課題も多く、今後も調査・研究が必要であることが明らかになった。
