2002年7月に知的財産戦略会議の手により、「知的財産国家戦略大綱」がまとめられ、同11月には「知的財産基本法」(平成14年法律第122号)が日の目をみた(12月4日公布)。知的財産権への包括的な取組が新世紀日本の根幹をなすことが改めて承認された。国レベルの動きと並走して、企業や個人による知的財産を巡る訟争は質量ともに増加の一途をたどり、「パテント・コート」構想が急速に展開している。従来、知的財産権は工業所有権を中心に、産業政策上の制度としての色彩が強調され、それを最も具現する「属地主義」を基本に議論が展開されてきた。しかし、近時の動向は「財産権」としての知的財産権(最小平成14年9月26日判決)の普遍性が今後より重要であることを示唆している。「保護国法」を軸にした体系化が、知的財産法制の安定・発展には必須の課題であるとの結論に至った。知的財産権の資産価値の増加は、他の法分野との関係・抵触を増加させている。とりわけ、伝統的に知的財産権と同じく「属地主義」の原則が支配するとされてきた破産法(とりわけ「外国倒産処理手続の承認援助に関する法律」施行以前)および税法との関係は、従来あまり検討されてこなかった。重層的な属地主義とも言うべき様相が、学際的な研究を阻んできたのではなかったか。そこで、保護国法を軸とする国際知的財産法の視点から、国際知的財産をめぐる破産法や税法上の問題を検討することによって、この分野の新たなビジネスモデルを呈示できないかと考え、検討を進めてきた。結論としては、上記諸法なかでも近時属地主義緩和の傾向にある破産法との関係においては、知的財産権の価値を普遍的に捉えることにより、破産債権者の保護等により資することが明らかとなった。
