项目摘要

神聖ローマ帝国(ドイツ)における絶対主義時代の犯罪と刑罰に関する研究の重要さに鑑みて、研究対象領域を18世紀後半のリッペ伯領に移した。リッペ伯領とは、現在のノルトライン・ヴェストファーレン州北東部にかつて存在した小領邦である。小領邦を選んだ理由は、プロイセンなどの大領邦にくらべて研究が遅れているからである。具体的な犯罪領域として風俗犯罪、とりわけ婚外・婚前交渉を選んだ。風俗犯罪を取り締まる規定は、当時の刑法・ポリツァイ法体系において、ヴォリューム的に大きな部分を占めていたにもかかわらず、これまで十分に研究されてこなかったからである。研究の視点として、近年の学会動向にそって、規範と現実との差異の問題、すなわち規範がどの程度通用していたか、という点に注目した。その結果、17世紀の「宗派化」の時代に、「永遠の浄福」を実現するために民衆のモラルを規律化しようとして制定された婚外・婚前交渉禁止令は、その後進展した「世俗化」を通じて、18世紀後半にはその目的を変え、富・財の拡大という経済的目的のために、民衆、とりわけ下層民のモラル化を推進しようとして適用されていたことが明らかとなった。このような目的の変化の結果、法令に従えば、あらゆる婚外・婚前交渉が規律化の対象となるにもかかわらず、富・財の拡大という観点からモラル的に劣っていると判断された下層民の婚外・婚前交渉がもっぱら規律化の対象となり、それに対して富裕農民の婚前交渉の慣習は、統治権力のそれに対するコントロールが、農村自治を担った富裕農民の人的ネットワークに阻まれてあまり成功しなかったこととあいまって、犯罪化・規律化されなくなっていった。以上の内容を論文「18世紀後半ドイツ・リッペ伯領における風紀ポリツァイ-婚外・婚前交渉禁止を例に-」にまとめ、現在『歴史学研究』に投稿中である。
