项目摘要

本年度(初年度)は、既に提出した「本年度の研究実施計画」に従い、以下の2点を中心に研究を進めた。まず、グラーティアーヌス教令集において法源論を扱う第1章-第20章、とりわけ教皇令の(規範としての)効力と序列に関わる第12章-第20章について、採録された個々の規範テクストの成立史とグラーティアーヌス教令集に至るまでの伝承過程を考察した。すなわち、4-6世紀における教会の変動と規範のあり方の変化、ならびに、そこで産み出された新たな規範テクスト(教皇令)がグラーティアーヌス教令集に辿りつくまでの経路と伝承形態(媒体となったカノン・コレクション)、の解明に努めた。次に、拠るべき規範を確定し、諸規範相互の関係を考える、という思考(法源論)そのものがどのようにして成立したのか、それが規範の解釈とどのような関係に立つのか、を考察するために、規範の序列を初めて定式化した11世紀の思想家コンスタンツのベルノルトの著作を網羅的に検討し、グラーティアーヌス教令集と比較した。その際、ベルノルトの思想を単純に体系化するのではなく、ベルノルトの思想の背後にある規範伝承の解明をも試み、ペトルス・ダミアニ、グレゴリウス7世の書簡・教皇令等を検討した。ベルノルトが参照したカノン・コレクションとベルノルト自身の付した註釈については、史料(マイクロフィルム)入手の遅延から、残念ながら今年度中には検討できなかった。この他、グラーティアーヌス教令集以後の発展をも、予備的にではあるが、考察した。とりわけ、グラーティアーヌス教令集以後最も重要な教皇令集Compilatio Primaについて、その成立史を中心に検討を始めた。
