本研究においては、倒産ADRの代表例として特定調停手続に着目し、必ずしも全ての利害関係人(全債権者)の手続参加が要請されるわけでもなければ、弁済計画も個々に立てられるといった特徴を有する同手続が、そもそもにおいて果たして法的な倒産処理手続と同列に考えることができるのか、とりわけ、従来とらえられてきた債権者平等原則との関係においては大きな疑問を生ずるところであるが、現実的には同手続が実質的な倒産処理手続としての機能を果たしていることは否めないことから、伝統的にとらえられてきた概念との相違を踏まえつつ、倒産ADRにおける債権者平等原則の意味内容の解明に取り組むことを目的としてきた。平成16年度においては、前年度の研究結果を踏まえたうえで、倒産ADRと債権者平等原則との関係について研究を進めた。具体的には、まず、わが国における倒産ADRの実情把握に努めるべく、とりわけ特定調停手続について同手続における債権者の手続参加の状況ならびに弁済計画の策定を中心とした利用状況の分析を行った。同時に、アメリカ合衆国においては倒産ADRが利用されるに際し、債権者間の利害調整はどのように考えられているのかという点も、考察すべき重要なポイントと思われることから、同国における債権者平等のとらえ方について、債権者債務者法ならびに連邦倒産法を中心に検討を進めた。
