本研究は、汚染物質の排出規制に関する研究と環境紛争処理に関する研究から構成される。まず、排出規制に関する研究実績から報告する。2006年8月4日に名城大学で開かれたアジア環境政策研究会にて中国の汚染賦課金(排汚費)制度に関する招聘報告を行った。同研究会は、東アジア地域の環境政策における経済的手法に焦点を当てた研究会であり、韓国および台湾の汚染賦課金制度に詳しい研究者と有意義な研究成果の交換を行うことが出来た。また、汚染賦課金(排汚費)制度に関する研究成果として、2007年3月20日発行の『国際開発研究フォーラム34号』に「中国汚染賦課金(排汚費)の法的性格と汚染防止法制の課題」と題する論文を発表した。同論文では、汚染賦課金が経済的補償に過ぎず制裁的性格はないと解釈されてきたにも拘らず、実際にはさまざまな規制基準や法規に反する行為にも適用されてきており、このような公的解釈と現実の運用状況との隔たりは違法性に関する不透明で明確性に欠ける判定基準を反映するものであることを指摘した。次に環境紛争処理について、2006年7月25日発行の『環境と公害』第36巻第1号(中国の環境問題特集)に「福建省寧徳市屏南県における公害訴訟-中国公害訴訟の現状と課題-」(p.32,33)と題する論考を発表した。また、2007年4月発行予定の『中国環境ハンドブック2007-2008』(蒼蒼社)に「福建省の訴訟事例に見られる公害被害者救済の現状」(pp.133-143)と題する論考が発表される予定である。これらの論考は、2004年度から3回にわたり訴訟現地で行った環境紛争処理の現状についての聞き取り調査をもとに執筆したものである。
