Research on modern change of forgery and its effect on criminal law theory and practice

本研究的成果如下：(1)阐明了作为现行《日本刑法》渊源的《1871年德意志帝国刑法》中关于各种伪造品(包括伪造品)的讨论的进展，以及1851年《普鲁士刑法》的立法过程及其对后世的影响：(2)通过对日本从原《刑法》到现在的《日本刑法》关于各种伪造品(包括伪造品)的讨论的发展，阐明了现代问题的根源；(3)阐述了以判例法和其他实践为主要驱动因素的日本、德国对各类伪造罪讨论的形成及其对刑法理论研究的影响。

Outcomes of this research are following : (1) Elucidating development of discussion as to various types of forgery (including counterfeit) in the Criminal Code of the German Empire of 1871, which is origin of current Criminal Code of Japan, and process of legislation of the Criminal Code of the Prussia of 1851, as well as its effect on following generations ; (2) Elucidating origin of modern problems throughout considering development of discussion in Japan as to various types of forgery (including counterfeit) from the former Criminal Code of Japan to current Criminal Code of Japan ; (3) Elucidating formation of discussion on various types of forgery in Japan and Germany, which is mainly driven by case law as well as other practice, and its effect on theoretical criminal law study.
