私の研究関心は、犯罪事実の認識・予見である故意を欠くにもかかわらず、例外的に処罰対象となる(刑法38条1項但書)過失犯について、伝統的な理論刑法学を踏まえながら、日独の最新の刑事法学の比較研究に基づいて、その帰責基準を精緻化し、もって具体的問題の解決を目指す点にある。2007年度後半から在外研究を開始し、現代的な刑事過失論に重要な影響を与えているドイツの諸理論の展開を分析しつつ、我が国の議論状況と比較・検討する作業に、十全に従事できた。

The study of privacy is concerned with the understanding of criminal facts, the observation of intentional failure, the exception of punishment, the object of punishment (Article 38, Item 1, proviso of Criminal Law), the theoretical criminal law of negligence, the theoretical criminal law of the latest criminal law, the refinement of the basic principles, the refinement of the responsibility standards, and the solution of specific problems. In the second half of 2007, foreign research began, and the important influence of modern criminal negligence theory was analyzed. The discussion situation in China was compared and discussed.
