项目摘要

本研究は、近年の大統領がしばしば立法府や司法府を介さずに政策を変更するために用いるようになった特区認可権という手段に着目し、大統領がそれを立法府から授権された当初の意図とは異なる政策変更手段として運用目的を変えただけでなく、そうした運用の利便性を高めるための制度整備を進め、更にはこうした制度変容を福祉政策に限らず医療保険政策や教育政策にまで波及させることで、執政府の政策実現能力を強化していったことを歴史的に明らかにした。大統領の政策実現能力についての先行研究は、特区認可権の台頭について説明できない。従来の研究は、大統領の政策実現能力を強化する手段として、特区認可権以外にも、世論動員戦略(going public)、大統領行政命令(executive order)、行政協定(executive agreement)、拒否権交渉戦略(veto bargaining)、署名時声明(signing statement)などを指摘し、これらの手段の台頭について、社会経済的変化、政治文化の変容、国内政治状況の変化に求める。しかしながら既存研究は、連邦政府に視野を限定して論じているため、州政府との関係が前提となる特区認可権の台頭を分析対象とすることができなかった。連邦制が三権分立制に作用するという本研究の視点は、従来のアメリカ政治研究には見られない。従来の理解では、連邦制は単に、三権分立制に先んじて権力を分割する仕組みだと考えられていた。本研究は、連邦制が三権分立制に影響を及ぼす仕組みでもあるという新たな視点を提示した。そしてそうした分析視角から、近年の大統領の政策実現能力の強化の一部として、特区認可権の台頭を論じることができた。
