项目摘要

本研究の目的は、スウェーデンにおいて政府開発援助政策の評価手法として採用されている「人権アプローチに基づく評価(HRB評価)」に着目し、対ベトナム法学教育強化支援および立法能力強化支援を事例にその特徴を明らかにし、それを通じて法整備支援に適合的な評価手法とは何かという問題を実証的に検討することである。2017年度の主要課題は、スウェーデン側が実施する事後評価およびその評価結果を明らかにし、本研究が日本及びベトナムにおいて2016年度までに行った調査結果を踏まえ、スウェーデン側研究者と共に比較検討を行うことであった。また本課題に付随して、現在プロジェクトが進行中の対カンボジア法整備支援に活かされたベトナム法整備支援の成果についても調査を行った。カンボジアでは、対ベトナム支援の初期(1991年から2005年)に重視した法学図書機能強化(法学部司書の育成、データベース構築、人権教育)と同様、人権アプローチに基づく法整備支援手法が採用されていることが明らかされた。一方、主要課題である対ベトナム法整備支援の事後評価を含めた検討は、事後評価の実施自体が先送りとなったため実現することが叶わなかった。そのため、事後評価以外の評価報告書をもとに、実際に評価を担当した研究者とコンタクトを取りつつ検討を進めた。具体的には、スウェーデン側の評価研究者と共にベトナムでの調査結果について検討し、日本の評価制度との比較検討を行った。また、日本側の法整備支援関係者との研究会を通じ、HRB評価の特長(結果重視評価では見落とされる視点の解明)及びHRB評価を用いることによる負の作用(結果重視評価でなければ分析できない視点)について検討した。HRB評価手法は、プロジェクト単位の評価ではなく、プログラム単位（プロジェクトよりも長期且つ広範囲な目標を掲げるもの）の評価に適用可能性があることが確認された。

The purpose of this study is to clarify the characteristics of the case of strengthening legal education support and strengthening legislative capacity support, and to discuss the appropriate evaluation methods and problems for supporting legal development support. The main topics for 2017 are: post-evaluation of the implementation of the project and evaluation results of the project. The results of the survey conducted in Japan and Japan in 2016 are discussed in a comparative study conducted by the researchers on the project side. This project is currently under way and is currently under investigation.
