项目摘要

当初の計画通り、前年度から引き続き生乳クオータの法的性質に関する検討を進めた。前年度の段階で、ドイツ民事訴訟法の観点からの考察により、生乳クオータは「その他の財産権」として通常の財産権と同様に財産性が承認されるものであることが明らかになっていたが、2013年度はドイツ民事訴訟法の解釈論的研究と合わせて判例の検討を行い、生乳クオータ＝「財産的価値を有する公権」＝一定量の出荷についての課徴金の回避を可能とする法的地位、であるとの性格規定を導出した。本研究においては、以上のような法学上の分析を通じて得られた性格規定について、生乳クオータの財産性＝取引可能性を基本的に否定しないものであると捉えた。加えて、生乳クオータ取引に関する経済分析を行う既往研究をフォローし、生乳クオータ取引が行われない場合に対して、生乳クオータ取引を行う方が経済的合理性があるという論点を確認した。さらに、経済史的な分析もフォローし、希少性を起点として財産性を獲得した財はその価値を実現するために取引を必然的に導出することを一般的事実として確認した。以上の法学および経済学的分析から、生乳クオータの財産性及び取引可能性を否定する論拠は基本的には見出しがたいものであることを確認した。同時に、農業分野において、生乳クオータ制度のように生産調整等の目的から農業生産に関する権利を創出し、その取引を許容することは、農業生産の不適切化を惹起しかねないものであることを確認した。以上から、一度制度を開始したなら、農業生産に関する権利自体の財産化、生産実態から独立した取引対象化に必然的に至る生乳クオータ制度のような制度は、農業生産の持続性を損なう性質を内在している面が否めないことから、政策手法として採用する場合には十分慎重になる必要があることが確認された。
