项目摘要

今年度の目標は、アメリカにおける安全保障のために市民的自由・プライバシー権の侵害を伴う政策が、それを憂慮する勢力にもたらしたフィードバックの分類であった。さらに、それを指針に、9・11後のテロ対策がプライバシー権の侵害をもたらす勢力に与えたフィードバックを考察することであった。政策フィードバック概念がアクターに物質的利益をもたらす政策をもとに構築されてきたことから、本研究では明確な物質的利益をもたらさない安全保障のために市民的自由の侵害を伴う政策が市民社会にもたらすフィードバックを分析する際の指針となる以下の分類を行った。(1)団体を組織して対抗動員を行う機会とインセンティヴ:安全保障のために市民的自由の侵害を伴う政策の主な対象になる勢力が団体を結成したり、既存の団体の活動を活発化させて対抗動員を行うインセンティヴ。(2)類似した活動に携わるアクターが協力する機会とインセンティヴ:市民的自由の侵害を伴う政策の導入により、従来横のつながりが強くなかった権利の擁護に携わる団体が、結束を強める機会とインセンティヴ。過去に導入された市民的自由の侵害を伴う政策の主対象になった勢力が、現在権利を侵害されている勢力を支援するインセンティヴ。(3)異なる政策領域で活動する団体と協力する機会とインセンティヴ:市民的自由の侵害を伴う政策の導入により、従来この領域に関わっていなかったアクターが、将来的に自らも不利益を被ることを認識し、市民的自由擁護に携わるインセンティヴ。(4)大衆が草の根運動を組織する機会とインセンティヴ:市民的自由を制限する政策を憂慮する大衆が、対抗動員を行う機会とインセンティヴ。上記の分類を指針に、9・11後のプライバシー権の侵害を伴うテロ対策がプライバシー権の保護をめぐる政策ネットワークにいかなる変化をもたらしたかを愛国者法の改正、恒久化をめぐる政策過程を事例に考察した。

This year's goal is to protect the freedom of the public and to protect the rights of the public. The attack was launched on September 11, 2011. The concept of policy is to establish a policy framework for the benefit of material, and this study clarifies the following categories of policy framework for the benefit of material, security, and freedom of citizens. (1)The organization of anti-mobilization opportunities: security and protection of citizens 'freedoms; and the organization of anti-mobilization activities. (2)Similar activities include opportunities for cooperation, and opportunities for cooperation.
