A comparative study on implementation process of the education provision (article 24) in the Convention on the Rights of Persons with Disabilities.

By the end of this study period, almost one hundred countries have ratified the Convention on the Rights of Persons with Disabilities (CRPD). The Article 24, as a education provision, requires the development of inclusive education for all children including children with disability. This study aims to examine the education system in the USA, the UK and Australia, for the ratification of CRPD.In the USA which does not ratify the CRPD, there are some inclusive education systems with reasonable accommodation and support for developing self-advocacy skills under the Americans with Disability Act. The UK, which has been developing special needs education under the Disability Discrimination Act (DDA), ratified the CRPD on June 8, 2009. The UK declared that the general education system in the United Kingdom includes mainstream schools and special schools, which the UK Government understands is allowed under the Convention. In Australia, while the Disability Discrimination Act (DDA) has been implemented since 1982, the education standard was established on 2005, and the Disability Discrimination and Other Human Rights Legislation Amendment Act 2009 enacted on 2009 for revising the DDA. In the Australia education system, the standard under the revised DDA provides more reasonable adjustments for inclusion.In order to ratify the CPRD by Japanese government, from the view points of non-discrimination special needs education is needed with enriching more reasonable accommodation in school education. Considering the non-discrimination principle in the CPRD the special school education and special needs education should be reconsidered with new roles.
