项目摘要

「カンボジア王国における21世紀の財産権概念の変化とその展開」という文脈で2001年土地法と2007年民法典との関係を検討し、分譲マンションの建設や外国国籍を持つ住民の住宅購入を規制する新しい法制度の設立に関する調査を行った。従って、近年カンボジア国内で進行している立法整備に基づき、とりわけ不動産に対する所有権概念の展開とその新しい動向が理解することができ、今後の研究課題も一層に明らかにすることができた。1993年以降の憲法規定によって土地に対する私的所有権はカンボジア国籍を持つものに限られるため、外国国籍を持つ長期居住者は住宅の購入ができなかった。それは、不動産売買業界や金融機関及び外資企業を含める分譲マンションを建設している企業の事業展開に不利を与えると同時に長期滞在の外国人にとっても多少生活上の支障に導くことになった。この状況を改善するために、2007年民法典に規定する「土地の構成部分」に対する例外条項(123条)及び「共有」(202条)という規定を利用し、国会は2010年に「外国人が共有する建設物の私的部分に対する所有権法」(以下「共有建設物法」)を採択した。従って、外国国籍を持つものに不動産の所持・売買と処分に関する権利を部分的に認める方向になっている。この配慮は、憲法の国益重視原則と市場経済のグローバル化の現実との関係を見直すようにも理解することができる。しかし、2001年の土地法と2007年民法典との関係については曖昧な論点を残したまま2010年の「共有建設物法」が採択されたことに法的な問題があると言わざるをいない。例えば、土地の構成部分の例外として認められる住宅を外国人が購入する場合、その付着する土地にまで外国人の共有を認める形で土地所有権を与える傾向についてはどのように理解すべきかなど、引き続き検討する必要がある課題が若干残っている。
